Enrolment terms and conditions

These terms and conditions form part of Amy McDonald enrolment agreement with you and apply to the program you have specified and for which you wish to enrol, to the exclusion of all other terms and conditions issued or stipulated by anyone other than Amy McDonald. In these terms and conditions, all references to ‘I’, ‘we’ and ‘us’ mean Amy McDonald and Amy McDonald Wellness.

1.       Payment for Enrolments

If you pay in full when you enrol then you are eligible for the special ‘paid in full’ pricing—otherwise you will be charged the payment plan pricing and placed on a payment plan (where available). If you do not set up a payment plan within 7 days we reserve the right to cancel your enrolment and a refund will not be available. In either case you are responsible for the full payment of fees for the entire Program regardless of whether you actually attend, complete or use all of the component events, products or inclusions (as applicable).

2.       Payment Plan Must be Up to Date and Complete

All fees must be paid on time in order for you to attend and participate in the Program. For ongoing Programs this means if your payment plan is not up to date then you will not be allowed to attend the next event in the Program, and you must have finalised all payments in order to attend the final event. Program privileges including memberships, media, websites and other assets may be revoked, disabled or withheld as we deem appropriate if payments are not made.

3.       Payment Plan Administration

We will set up your payment plan through paypal. Any changes to your payment details must be received in writing to amy@amymcdonald.com.au 5 days prior to your next scheduled debit date. It is your responsibility to advise us and refunds will not be given due to your failure to notify us within this time.

4.       Program Completion Term

All Programs must be completed within the stated program terms. There will be no credit for enrolments not completed within this time.

5.       Program Changes

If for any reason we deem it necessary to change any seminar or phone call dates, venue, city, speaker, content, title or hours we may do so by notifying you of the changes we make. There is no refund available under any of these circumstances. In the event that we change any dates requiring physicalattendance, you can reschedule your enrolment without penalty if you want to, providing alternative dates are available.

6.       Enrolment Cancellation

All registrations in all Amy McDonald Wellness and Amy McDonald group and private coaching programs and events and retreats are non-refundable.  If you do not attend a Program component in which you are enrolled a refund or credit is not available and you will need to purchase the Program again if you wish to attend a future similar event.

If you cancel a single coaching session within 12 hours of the appointment your session will be forfeit. A minimum of 12 hours is required to reschedule an appointment.

7.   Specific Program Exclusions and Inclusions

All your domestic and international flights, local travel costs or transfers and travel insurance costs are not included and are at your own expense. Please refer to the itemised Program details for inclusions. Accommodation is only included in specifically listed in the Program details and in this case a non-refundable accommodation deposit will apply.

8.   Product Warranty (if applicable)

If any product that you receive with your enrolment is found to be faulty, our only obligation to you it to replace the faulty product within 10 business days of your written request and return of the faulty product.

9.   Partner/Friend discount (if applicable)

If you are enrolled in this program as the partner or friend of a full fee paying participant and you have received a partner or friend discount on the Program, should your linked full fee paying participant cancel their enrolment your discount will no longer apply and you will be required to pay the full fee for the Program.

10.   Financial, legal and medical advice disclaimer

We make no representation and give no warranty to the accuracy or completeness of the information provided at or in relation to this Program and do not accept responsibility for any errors or inaccuracies in, or omissions from, the information contained therein. The information provided during or in relation to the program is for general purposes only and it does not purport to be comprehensive or to render specific advice. Nor should it be regarded as financial, legal or medical advice. If any information or advice that may constitute financial, legal or medical advice is given at or in relation to an event, such advice is not authorised by Amy McDonald and does not constitute financial, legal or medical advice given by Amy McDonald . This disclaimer does not purport to exclude any warranties implied by law which may not be lawfully excluded.

11.   Intellectual Property

All material relating to the Program for which you are enrolling whether presented during, before or after the Program, is subject to copyright and other intellectual property rights.  The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner. You agree not to do anything, at any time that would infringe the intellectual property rights in such materials.

Group programs will be recorded and these recordings may be sold as stand alone programs in the future. By participating in any group program, event, retreat or coaching event with Amy McDonald you consent to having your voice recorded and these recordings sold at a later date. You also agree that there will be no financial or other form of compensation for you for this.

12.   Confidentiality

We respect your privacy and must insist that you respect the privacy of other fellow participants. You agree not to disclose proprietary information, ideas, plans and trade secrets that are disclosed by other Participants in confidence, nor to violate the publicity, privacy or intellectual rights of any Program participant.

13.   Application Approval and Termination of program enrolment

We are committed to providing all participants with a positive experience and may not approve all applications to join this program. In this case we will refund you the amount paid to us less any enrolment cancellation costs. Once the Program starts, we may terminate this agreement and your participation in the Program without refund or forgiveness of remaining payments if you become disruptive or difficult to work with, if you fail to follow the Program guidelines, or if you impair the participation of others.

14. General

The laws of the state of Victoria govern this agreement. Should any part of this agreement be determined by court to be invalid or unforeseeable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of Amy McDonald. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. Such terms, conditions and warranties implied by statute that are not excludable are not excluded from this agreement but our liability for breach of such conditions and warranties implied by statute that are not excludable is limited to the total amount paid by you to Amy McDonald under this agreement.
